Who do i call when the new M.O.T rules hold me to ransome ?

Even the drop link swivels function just as they did when they were new .

There was no problem with the front arb because i removed it before the test , and the rear one isn't going back on either . But next time something fails i will be saying show me and i find it very easy to imagine the police being called .

Appeals against MOT inspections[edit]
Motorists who recently had a vehicle MOT tested and disagree with the outcome of the inspection are entitled to an appeal against the decision. The appeal must be lodged with DVSA/DVA within 28 days of the original test date if the items in question are mechanical in nature; three months are allowed for corrosion issues, except for corrosion of brake discs, brake lines or the exhaust system. Mileage, or the lack thereof, incurred after the inspection has no relevance to the appeal even if the vehicle has not been used for several months after the test.

If the items in question are repaired, replaced or removed from the vehicle, the right of the owner to appeal becomes null and void. Failure because of items easily replaceable, such as tyres or windscreen wiper blades, may not be appealed against, as it cannot be adequately determined if they were the ones fitted at the time of inspection.

To appeal against an MOT pass is free of charge, but appeals against a failure incur a fee whose value would amount to the normal maximum price of an MOT for that vehicle. This fee is then refunded if the appellate inspection finds in favour of the motorist lodging the appeal. If the appellate inspection finds the vehicle was incorrectly diagnosed, DVSA/DVA takes appropriate action against the station involved. This can range from penalty points being issued for minor infringements, to the station's MOT licence being rescinded for more major violations.

DVSA/DVA has only the power to discipline the station involved and cannot pursue compensation of any kind for the complainant; that is the responsibility of Trading Standards. An MOT station cannot be held responsible for defects that occur to the vehicle several months after the test was conducted. The appeal process is outlined on the reverse of the VT20 pass certificate and the VT30 failure notice.
 
Put them back on torque it up and take it back for the free retest. Then stand there and watch em. If it passes challenge them if it doesn’t get the to show you the movement.

Those bushes look to be good condition imho

Honestly Shayne they're so dangerous I'm surprised you even made it to the test station alive......... now we can all see what gives the motor trade a bad name
 
Will the Land Cruiser still handle okay with out the back and front ARB’S ? Or have you just removed them for the MOT, then put them back on?

Removing front made no difference at all to my 90 Steve so they won't be going back on .

The bushes and drop links are virtually brand new parts .

I have perfectly good steering rack bushes in the shed that another garage made me replace last year and god knows what other spare parts all good all failed .

Right now i have the 3 or 4 year old steering rack off to polish the pipes because i'm damned if i ca find the one that got the advisory for being corroded ?

And i have an awful feeling my front shocks failed for "excessive leaking" because i was planning to remove them anyway , so i can replace the lower control arm bushes which are ruined but passed inspection without a mention , and so i've been spraying penetrating oil on everything for a few weeks prior to mot .

16 mot test stations in my town and i drive to Cardiff instead , i gave up locally when i paid for wheel alignment and then "fixed it" myself using string . Call me fussy but i think track rod ends should be adjusted evenly instead of at opposite extremes .

I would like to see a government bait car in permanent circulation to test the testers .

And me. One that knows these trucks and how much flex they need.

In answer to the original question Shayne, if they fail your truck and you can then not drive it under the new rules, immobilise it by removing an essential part or connection then arrange for it to be towed back to your place for repair as a breakdown.

This begs another question, what happens if you take your vehicle to someone that just does MOTs and not repairs?

I have to say those bushes look mint. All of them.
 
That's why I prefer the system we have here. Testing is independent in a Govt backed system run by a private operator. No repairs offered on site, so no chance of failing something just to get some cash out of you.

I've also had worse bushings pass a test here than yours Shayne!
 
It's just a nuisance to me but i'm thinking of the bigger picture , when your sat in a pub listening to someone who has 5 jobs talking about giving up their internet so they can pay car insurance monthly , that hundred pound or whatever to fix something that isn't broken might as well be a million .

I have a 4 page m.o.t report (bearing in mind everything is repeated in Welsh) and the only thing of any concern they did pick up on was play in the steering (they blamed everything but the cause) and i truly think its because mine was the last vehicle tested on a Friday and though i was an hour early for my slot they didn't take the keys until 5pm .

Next month that same bullshit might cost someone their job .
 
I had a landrover (sorry!) failed on bushes, took it to a Landy specialist and it passed no problem. As has been said above, I think some stations just don’t understand 4x4s and how much they are designed to flex
 
How about taking it to the local council MOT testing station for a retest?

I think the problem may be where Shayne has removed the bushes in question. Unfortunately the rules seem to state this voids any complaint.

I read the complaints procedure Animal - they can fail a brand new car in perfect condition for having a broken windscreen and you must leave the evidence that its not broken with them for 3 months - you might get your 30 quid test fee back - assuming they don't break the windscreen :crazy:

@Moggy good idea that if they will pass a lamedrover they will pass anything surely :lol: sadly i can't find a landrover specialist that does m.o.t's less than an hours drive away though i did find one that might be worth checking out if i want work done :thumbup:

As i say i'm not so bothered by the nuisance right now but if i have to hire a trailer to get my truck home every time one of these fuckwits has a bad day i find it very easy to imagine me losing my temper in a garage and that never ends well .
 
Before you get on the soap box, you have to check for wood worm and that the boards are securely fixed down!
